South of Heaven: Conditions of Entry, Waiver and Release

South of Heaven Limited (ABN 94 630 573 027), an Odinist church ("the church", "we", "us")

These conditions apply to every South of Heaven gathering, including Weekend With Hooks 2027 (1–2 October 2027, Maryborough VIC) and Run Through The Hills 2027 (9–11 April 2027, Albury NSW), and to gatherings held with the Freedom Riders Union, a constituent of South of Heaven. By buying a ticket or attending, you agree to these conditions. Please read them before you buy. Contact: headoffice@southofheaven.net.au

1. Your consumer rights
Our tickets come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these conditions excludes, restricts or modifies any right or remedy you have under that law or any other law, except the limited waiver for death or personal injury from recreational services in section 3, which the law allows.

2. You take part at your own risk
Our gatherings are held outdoors, often in remote country areas. They involve motorcycle riding, camping, live music, film screenings, crowds, alcohol and changing weather, including heat, cold, storms and fire danger. These carry obvious and inherent risks of injury, illness, or even death, that can't be removed even when reasonable care is taken. Medical help and phone reception may be far away. You choose to attend and take part, you accept these risks, and you are responsible for your own health, fitness, water, food, medication and sun protection.

3. Waiver and release for recreational services
What it covers. Riding, camping and other physical activities at our gatherings are recreational services. To the extent the law allows, you agree that, for death or personal injury only, our liability under the statutory guarantees (that services are supplied with due care and skill, are reasonably fit for any purpose you make known, and achieve any result you make known) is excluded. You release the church, its directors, officers and volunteers, and the Freedom Riders Union, from claims for death or personal injury arising from those services. This relies on section 139A of the Competition and Consumer Act 2010 (Cth) and section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic).

What it does not cover. This waiver does not apply to: significant personal injury caused by our reckless conduct; death or injury due to our gross negligence; loss or damage other than death or personal injury; or any right the law says cannot be excluded.

NSW gatherings. For gatherings in New South Wales, including Run Through The Hills, section 2 and this section are also a risk warning for the purposes of section 5M of the Civil Liability Act 2002 (NSW).

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012

If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you—

• are rendered with due care and skill; and
• are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
• might reasonably be expected to achieve any result you have made known to the supplier.

In accordance with section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. "Gross negligence", in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2022 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

4. Riders
Riders ride their own registered motorcycles on their own licences, at their own risk and under their own responsibility. If you ride to or at a gathering, you must ride a roadworthy, registered motorcycle, hold a current licence for it, wear an approved helmet, obey all road laws and police directions, and never ride affected by alcohol or drugs. Group rides, including Run Through The Hills, are social rides on public roads. They are not races, rallies or speed events. The church does not supervise or control anyone's riding, or the traffic or roads, and you alone are responsible for how you ride. This doesn't limit your rights under section 1, or our responsibility for anything we do ourselves.

5. Camping and venues
Camping at Run Through The Hills is at the pub or hotel venue, which is run by a third party and not by the church. Campers must follow the venue's rules and the directions of its staff. Each person is responsible for themselves, their gear and their own conduct. The church is not responsible for the venue's facilities or services, except for anything we do ourselves or where the law says otherwise.

6. Event rules, entry and removal
You must follow the event rules, signs, and directions from church officials, security, police and emergency services. Drink responsibly; we may refuse to serve alcohol. No illegal drugs and no weapons. We may refuse entry to, or remove, anyone who breaks these conditions or the law, is drunk, violent or abusive, or puts others at risk. No refund is given in that case.

7. Tickets and refunds
Refunds: tickets are not refundable for change of mind. If the event is cancelled, you will receive a full refund. This does not affect your rights under the Australian Consumer Law.

8. Under-18s
Where under-18s are allowed (check the event page), they must be with their parent or guardian at all times. The parent or guardian accepts these conditions for the child and for themselves, and is responsible for supervising the child.

9. Medical treatment
If you are injured or unwell and can't decide for yourself, you agree that church officials may arrange first aid, an ambulance and any medical treatment they reasonably believe you need. You are responsible for the cost of ambulance and medical treatment.

10. Photos and video
Gatherings are photographed and filmed. You agree that the church and the Freedom Riders Union may use photos, video and sound of you, without payment, on their websites and social media and to promote the church and its gatherings. If you don't want to be featured, tell a church official on the day or email us, and we will avoid using, or remove, your image where reasonably possible. We won't feature a child's identifiable image without their parent or guardian's consent.

11. Your property
Bikes, vehicles, tents and belongings are brought at your own risk. We are not responsible for their loss, theft or damage, except where caused by our negligence or where the law says otherwise.

12. Responsibility for your own conduct
To the extent the law allows, you agree to make good any loss, damage or claim against the church, its directors, officers and volunteers, or the Freedom Riders Union, that is caused by your own unlawful, deliberate or careless act at a gathering, for example damage you cause or injury you cause to someone else. This does not apply to the extent the loss was caused by us.

13. General
These conditions apply to each gathering you attend. If any part is invalid, the rest still applies. They are governed by the law of the State where the gathering is held. Questions: headoffice@southofheaven.net.au
